The Law Firm of Fiorenzo Perucchi, Esq., established in Lugano in 1959, is now run by the founder’s daughters,  Simonetta Perucchi Borsa and Francesca Perucchi Casamassima.
For more than 50 years the firm has been serving a local, national and international clientele.

We are located in the financial, administrative and judicial center of Lugano.

We offer a great variety of services in the most diverse areas of law, not least thanks to a broad network of Swiss and foreign correspondents which enables us to find solutions for and to counsel our clients even in the context of international issues involving multiple jurisdictions.

In addition we also act as financial intermediaries and are members of the profession’s Self-Regulatory Organisation.

We serve our clients in matters of private and public law; in the fields of civil law (family and estate law), obligations law, contract law, corporate law, tax law, bank law as well as in matters of administrative procedures, unlawful competition, financial criminal law (offences against assets) and collections and bankruptcy law.

We accept mandates as legal consultants and attorneys within the framework of legal disputes and controversies before courts of all levels and we assist our clients – Swiss as well as foreign individuals and corporate entities – in connection with administrative procedures.

Services We Provide

Family Law

Our Law Office deals with any matters relating to family law; it lends legal prenuptial consultancy, assistance in case of separation or divorce and in coonnection with any changes in the terms of separation and divorce. We handle delicate situations involving the recognition and care of children, their custody, their support and visiting rights. We assist clients in the implementation of measures pronounced within the context of family law, such as e.g. the collection of support or alimony payments and wage withholdings from the support debtor.

Estate Law

We assist clients with legal and notarial formalities in matters of inheritance and estate. We provide counseling toward the preparation of last wills and testaments, estate contracts and division contracts.
We follow litigation proceedings in estate matters and we accept mandates as estate executors.

Corporate and Commercial Law

We offer legal consultancy and notarial services in matters involving Swiss and foreign corporate law. We set up companies, subsidiaries and branches of Swiss and foreign entities; with the assistance of specialists we operate in the area of mergers and acquisitions. We assist our clients in contract matters involving corporate and business problems and parasocial agreements.

We counsel and assist clients in matters of commercial law (amendments to bylaws or changes of company officers, increases or reductions of capital, transfer of company shares etc.).

Tax Law

Our law firm – seconded by its own network of specialists – offers counsel to individuals and corporate entities in relation to tax formalities and procedures in Switzerland (on tax returns, real property capital gains, added value tax, withholding tax, gift and estate taxes) and abroad. We assist our clients in domestic and international tax planning, even in connection with double taxation treaties. We deal with voluntary disclosure and we follow tax ruling cases.

We also provide counsel in matters relating to the issuance of residence permits, inclusive of fiscal planning involving lumpsum (global?) taxation.

Bank Law

We offer consultancy in matters of bank law and we follow interactions with bank and financial supervisory authorities. We also accompany transactions involving acquisitions in this field as well as the creation of banking institutions or other financial enterprises.

Foundation and Trust

We handle the creation of foundations, family foundations and trusts, and we accept mandates as trust protectors and as members of Foundation boards.

Contract Law

We provide assistance to clients in the negotiation and drawing up of a vast array of contracts, such as e.g. sales contracts, bidding tenders, service contracts, rental agreements, employment (and non-competition) contracts, as well as agency, franchising and partnership agreements, etc.

Labor Law

Our Law Office offers assistance to both employers and employees on the various aspects of labor contracts. We handle the negotiation and preparation of labor contracts and services. We follow matters under litigation (e.g. terminations, non-competition clauses, instances of mobbing, insurance issues etc.).

Health, Medical and Social Insurance Law

We provide counsel and assistance to our clients, even in the course of litigation, in matters pertaining to health, medical and social insurance law. Thus we deal with various aspects of medical liability, of patient rights (informed consent, access to the medical records, professional secrecy, etc.) or coverage of care by social insurance carriers. We lend support and assistance in procedures of appeal against the denial of social services (e.g. in the case of unemployment, illness, disability, etc.).

Law on Rentals, Co-Ownership and Neighbor Relations

We offer our clients counsel and assistance in matters involving leases (private or business), rentals and co-ownership relations.

We provide consultancy and assistance in drawing up rental agreements and we follow litigations arising from the rental relationship such as, for instance, procedures to controvert terminations, extend the duration of a lease, increase or reduce rent, eviction proceedings or the restitution of guarantees, etc.

We also offer counsel and assistance in matters regarding co-ownership problems such as e.g. challenging resolutions of co-owners’ meetings in condominial properties or the allocation of condominial expenses, etc.

Assistance is also offered to settle controversies among neighbors in the case of disturbances caused by the production of irritating smoke, noise, unpleasant smells, etc.

Law of Art Objects

We are familiar with and will explore issues related to the commerce with as well as the ownership, lending and sale of art objects.

Administrative law

We advise and assist private clients and public entities in matters involving administrative law, particularly with respect to
– territorial planning
– construction law (e.g. procedure to oppose and controvert building permits, contributions for improvements, expropriation, tax
assessments, etc.).

IT (Internet Technology) Law

We offer advice on matters relating to data processing and transmission through the internet. In particular, we provide assistance for the launching of an e-commerce activity (e.g. with contracts for the creation, management and maintenance of the website, contracts regarding online marketing, the preparation of general terms and conditions of sale or the provision of services; consultancy in connection with data protection and security, payment systems, hosting, etc.).

Building Law

We provide consultancy and assistance to builders and contractors for the proper preparation of building contracts, particularly those contemplating the construction or renovation of real property items.

We assist clients in judicial procedures such as the registration of pre-emptive mortgages and lawsuits relating to repairs to real property items or seeking to reduce compensation in the event of defects.

Recovery of Claims and Bankruptcy Proceedings

We handle cases for the recovery of claims, both in the initial out-of-court stage and in the subsequent court proceedings. Initially we carry out an analysis of the debtor’s payment capability; thereafter, if the premises are given, we move to recover the amount owed (by means of a forcible collection procedure or via a claims enforcement action, through precautionary proceedings aimed at protecting the claim and/or liens, the enforcement of guarantees, the recognition and implementation of Italian injunctions, etc.).

We also lend assistance in bankruptcy proceedings.
